After the expiration of a tenant's lease agreement, they may be curious about the duration for which they can continue residing at the property before vacating. The answer to this query is dependent on the type of tenancy agreement that the tenant has entered into.    

Fixed-Term Tenancy Agreements      

In a fixed-term tenancy agreement, the tenant is given a specific period of time to occupy the property, usually one year. Once the fixed term has expired, the tenant must vacate the property unless the landlord and tenant agree to renew the tenancy agreement. If the landlord does not want to renew the tenancy agreement, they must serve the tenant with a notice to quit at least one month before the end of the fixed term.      

Periodic Tenancy Agreements      

A periodic tenancy agreement is a tenancy agreement that does not have a fixed term. Instead, the tenancy agreement is renewed on a monthly, weekly, or daily basis. If the tenant does not vacate the property at the end of the period, the tenancy agreement is automatically renewed for another period. The landlord can only evict a tenant from a periodic tenancy agreement if they have a valid reason, such as non-payment of rent or breach of the tenancy agreement.      

What to Do If a Tenant Refuses to Vacate      

If a tenant refuses to vacate the property after their tenancy agreement has expired, the landlord can take legal action to evict them. The landlord must first serve the tenant with a notice to quit. If the tenant still refuses to vacate the property, the landlord can then apply to the court for an eviction order.
